On Friday, MSNBC “Morning Joe” co-host Mika Brzezinski said that she didn’t believe that Republicans were smart enough to understand the differences between the current classified document scandal engulfing the Biden administration and the documents found at former President Donald Trump’s Florida estate last year.
Over the past week, classified documents have been found in the Penn Biden Center in Washington, D.C. as well as Biden’s Delaware home inside a locked garage. The classified material is from Biden’s days as vice president and has allegedly been stored in these locations since he left Obama’s side in 2017.
Then-Vice President Biden did not have the ability to declassify documents at will, a power granted to the president. Former President Trump, however, did have that power and allegedly utilized it to declassify the documents at Mar-a-Lago in the waning days of his presidency.
This contrast, however, didn’t stop Brzezinski from attempting to defend Biden and malign Republicans with attacks on their intelligence.
“Politically for Democrats, the obvious immediate reaction here is ‘ugh, are you serious? Democrats were on such a roll. Republicans are now going to pounce on this, ugh.’” she said, as reported by Breitbart. “This downplays the significance of the Trump document scandal, right? I would suggest not so much, not so much at all.”
“Classified documents in private hands is something Republicans downplayed constantly until the shoe was placed on the other foot,” the co-host argued. “And unfortunately for them, the Trump shoe that dropped was much bigger and entirely different in the key issue of willful intent to obstruct. That’s what it’s going to come down to.”

“Many Republicans aren’t smart enough to figure that out, and they can’t figure out that this week’s developments actually make it more likely the DOJ moves on Trump because of the political space it has been given by the Penn Biden center and the garage where Joe Biden parks his corvette,” she claimed.
“Yes, it was sloppy. In the end, what is most important here is intent, willful intent to obstruct,” she argued. “What we know is that the Biden administration immediately handed over the documents, reached out to the national archives to say, ‘hey, we’ve got something here.’ We all know that Donald Trump held off, even in the face of a subpoena. Republicans are now telling us this is truly an important national security issue.”
President Biden has admitted that he accidentally took the classified material. Whether it was intentional or not, President Biden broke the law.
18 U.S. Code §1924: Unauthorized removal and retention of classified documents or material states that the removal of classified documents, irrespective of intent, results in fines or imprisonment:
“Whoever, being an officer, employee, contractor, or consultant of the United States, and, by virtue of his office, employment, position, or contract, becomes possessed of documents or materials containing classified information of the United States, knowingly removes such documents or materials without authority and with the intent to retain such documents or materials at an unauthorized location shall be fined under this title or imprisoned for not more than five years, or both.”
President Biden has clearly violated the law and should face the consequences for doing so. However, the likelihood of him actually being punished is low given the potential consequences of going after a sitting president as well as the left-leaning nature of the Department of Justice (DOJ).
If the DOJ fails to uphold its own law then it proves that there really is a dual system of justice in America. One where elites can get away scot-free and everyday Americans have to live by the laws that people like Biden create.
