The state of Texas is leading a coalition of nineteen other states and suing President Joe Biden’s administration after it massively expanded a humanitarian parole program allowing illegal immigrants from designated nations such as Haiti to stay in the U.S. for one month.

At Biden’s order, the Department of Homeland Security added in the nations of Nicaragua, Cuba, and Venezuela allowing up to 360,000 illegal immigrants per year to reside in the United States for up to two years and even receive work permits, according to Fox News.

When Biden announced the expansion of the ‘parole program’ he said, “We anticipate this action is going to substantially reduce the number of people attempting to cross our southwest border without going through a legal process.”

Texas and America First Legal launched the lawsuit alongside the states of Alabama, Alaska, Arkansas, Florida, Idaho, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, Ohio, South Carolina, Tennessee, Utah, West Virginia, and Wyoming.

Stephen Miller, President of America First Legal tweeted, “America First Legal partners with Texas & coalition totaling TWENTY STATES to file emergency lawsuit against Biden’s plan to fly illegals directly to US for instant entry. This “parole” scheme is the end of borders. Our suit aims to SHUT IT DOWN”

In the text of the lawsuit, the coalition of States asserts,

The Department (of Homeland Security)’s parole power is exceptionally limited, having been curtailed by Congress multiple times, and can be used ‘only on a case-by-case basis for urgent humanitarian reasons or significant public benefit.’ 8U.S.C. § 1182(d)(5)(A). But the Department’s new ‘parole’ program allows aliens in their home countries to obtain the benefit of being able to obtain advance authorization to enter the United States—despite no other basis in law for them doing so.”

The states conclude, “The Department does not have the authority to invite more than a third of a million more illegal aliens into the United States annually as it has announced with this program. This Court should enjoin, declare unlawful, and set aside the Department’s lawless parole program.”

“We can provide humanitarian relief consistent with our values, cut out vicious smuggling organizations, and enforce our laws,” Homeland Security Secretary Alejandro Mayorkas claimed in a statement according to Fox News.  “Individuals without a legal basis to remain in the United States will be subject to prompt expulsion or removal. Individuals who are provided a safe, orderly, and lawful path to the United States are less likely to risk their lives traversing thousands of miles in the hands of ruthless smugglers, only to arrive at our southern border and face the legal consequences of unlawful entry.”

In a statement to Fox News, Texas Attorney General Ken Paxton said “Every state in America, especially border states like Texas, is being crushed by the impacts of illegal immigration. The Biden open borders agenda has created a humanitarian crisis that is increasing crime and violence in our streets, overwhelming local communities, and worsening the opioid crisis. This unlawful amnesty program, which will invite hundreds of thousands of aliens into the U.S. every year, will only make this immigration crisis drastically worse.”

As noted by The Texas Tribune, Paxton has led Texas to file at least 20 different lawsuits against the Biden administration since the Democrats took power in 2021, with many regarding immigration. The Texas AG has seen success in temporarily halting some of Biden’s border policies. Most recently his office joined an Arizona-led lawsuit that upheld the enforcement of Title 42 restrictions.

In a statement released Tuesday Miller said, “This is a dramatic escalation in the open borders crusade – not only is Biden freely admitting illegal aliens who arrive at our borders, but he is now going to foreign countries to pre-approve innumerable illegal aliens to flood into our country without any legal basis whatsoever. It is illegal, unconstitutional, and contemptible. So once again, we are proudly joining with Texas, the incredible Attorney General Ken Paxton and a coalition of nineteen states to file this urgent lawsuit demanding an immediate cessation and halt to Biden’s treacherous scheme to flood our country with even more unauthorized mass migration. America First Legal will not relent in defense of our sovereign borders.“
