FBI Director Wray Flies To Las Vegas Amid Gamble With Congress To Avoid Contempt Charge

The Director of the Federal Bureau of Investigation Christopher Wray appears to be a betting man. Just a few hours after informing Congress that he would not comply with the terms of a subpoena to hand over an unclassified memo purporting to detail a bribery scheme involving a foreign national and then-Vice President Joe Biden, he jetted off to Las Vegas for a counterterrorism conference.

 Wray in his phone call with Republican congressional leaders, while refusing to hand over the memo to Congress, offered to allow the lawmakers to see the memo at FBI headquarters in an attempt to placate Republican politicians. His evasion of the subpoena has provoked Republican leadership to warn the director that he is at great risk of a contempt charge, according to Just the News.  

The FBI's national press bureau confirmed their director's departure from DC to the news outlet, writing, "Director Wray is speaking to counterterrorism and law enforcement practitioners at a conference in Las Vegas to reinforce the continued importance of the counterterrorism mission and thank them for their service...He is also scheduled to meet with FBI employees from the Las Vegas Field Office. There were changes made to the original itinerary to allow Director Wray to provide remarks at a 9/11 Line of Duty Death service on Friday."

The director's excuses and attempts to evade the full terms of the subpoena for the memo have not amused Republican leadership. Representative James Comer (R-KY), chairman of the House Oversight Committee, said that he plans to seek a contempt vote against Wray next week. Mr. Comer also mentioned that Wray confirmed the existence of this document in their telephone conversation prior to the Director's departure. "Today, FBI Director Wray confirmed the existence of the FD-1023 form alleging then-Vice President Biden engaged in a criminal bribery scheme with a foreign national...However, Director Wray did not commit to producing the documents subpoenaed by the House Oversight Committee," the chairman said.

"While Director Wray – after a month of refusing to even acknowledge that the form existed – has offered to allow us to see the documents in person at FBI headquarters, we have been clear that anything short of producing these documents to the House Oversight Committee is not in compliance with the subpoena," Rep. Comer elaborated. "If the FBI fails to hand over the FD-1023 form as required by the subpoena, the House Oversight Committee will begin contempt of Congress proceedings."   

Senator Chuck Grassley (R-IO) was also not amused with the FBI's conduct. Senator Grassley remarked, "While the FBI has apparently leaked classified information to the news media in recent weeks, jeopardizing its own human sources, it continues to treat Congress like second-class citizens by refusing to provide a specific unclassified record."

House Speaker Kevin McCarthy (R-CA) appears to have greenlighted the move against Director Wray. On Tuesday, the speaker is on record as saying, "If he misses the deadline today, I am prepared to move contempt charges in Congress against him...We have jurisdiction over this. He can send us that document. We have the right to look at that."
