In a letter to Homeland Security Secretary Alejandro Mayorkas coinciding with his hearing Wednesday, a group of Republican congressmen aligned behind Rep. Andy Biggs (R-AZ) condemned the Biden administration for closing or seeking dismissal of almost 92,000 deportation cases in 2022 alone.
The letter, obtained by Breitbart News, read in part, "The Secretary can undoubtedly connect the dots to realize that a massive amount of case dismissals is a component of the incentives this administration offers illegal aliens daily. You might try enforcing the law and allowing it to serve as a deterrent to illegal entry. Historical precedent exists to support the idea."
"You and OPLA leadership can make every argument you want about the latitude and benefits of using prosecutorial discretion, but this directive, coupled with this administration’s dangerous immigration policies, can only lead us to one conclusion — you have found another avenue to circumvent federal immigration law and exploited it to the detriment of the American people."
The Republicans co-signing the letter included fellow Arizonan Dr. Paul Gosar, Reps. Matt Gaetz and Byron Donalds of Florida, Michael Cloud, Jodey Arrington, Ronny Jackson, Brian Babin, Lance Gooden of Texas, Diana Harshbarger and John Rose of Tennessee, Ralph Norman of South Carolina, Josh Brecheen of Oklahoma, Matt Rosendale of Montana, Harriet Hageman of Wyoming, Eric Burlison of Missouri and Rich McCormick of Georgia.
Under the Biden administration, the number of illegal immigrants living in the U.S. in spite of existing deportation orders from a federal judge has ballooned to approximately 1.2 million, as reported by Breitbart. The Republican lawmakers are demanding to know exactly how many deportation cases were dismissed versus the number administratively closed. In addition, they want to know how many are under review to dismiss or close in 2023.
During a hearing before The House Judiciary Committee on Wednesday, Rep. Chip Roy (R-TX) asked Mayorkas, “[O]n April 28th, 2022, I asked you quote, ‘Will you testify under oath right now, do we have operational control, yes or no?’ You responded with, ‘Yes we do.’ I then asked, ‘We have operational control of the borders?’ You responded, ‘Yes we do.’ Followed up, I said, ‘I read to you the definition of operational control,’ I actually held up this chart, operational control is defined under the Secure Fence Act,” Roy told Mayorkas, according to The Daily Caller.
“I put up for plain reading, plain as day. I put up the second part of the same statute which defines operational control, which means the prevention of all unlawful entry into the United States including entries by unlawful aliens, incidents of terrorism, and other contraband. I said to you, ‘Do you stand by in your testimony that we have operational control in light of the step position?’ You responded with, quote, ‘I do.’”
According to The Daily Signal, he reminded the Secretary of the testimony of Raul Ortiz, then-Chief of the U.S. Border Patrol who said DHS did not and does not have operational control of our border.
It later came to light that no such activity had been observed and that Border Patrol Agents were merely controlling their horses. He concluded, '“It wasn’t until May of this year that you corrected the record and said, ‘Well let me just correct you out there because actually the investigation concluded we things did not occur.’ Don Rosenberg in this very room testified a few weeks ago that you lied. It is a perpetual pattern.”“This is a pattern,” Roy said. “Did you lie another time when you said on Sept. 24, 2021, at a press conference, ‘We know that those images painfully conjured up the worst elements of our nation’s ongoing battle against systemic racism,’ when responding to the alleged whipping incident by the Border Patrol agents who report to you?”
Rep. Hageman (R-WY) responded in equally grim terms to Mayorkas by telling him, "You are the walking talking epitome of the very tyrant that our forefathers recognized would gravitate towards government service. And it is because of people like you that they drafted the First Amendment."
She tweeted, "Isn’t it ironic that the person in charge of the Biden ‘mis and mal information’ agency spent the day lying to Congress? Secretary Mayorkas has failed the American people and it’s time for him to resign or be removed from his position."
