On Tuesday morning, Georgia State Representative Charlice Byrd (R) announced that she would be joining State Senator Colton Moore (R) in calling for a special session of the Georgia legislature to consider impeaching Fulton County District Attorney Fani Willis as 45th President Donald Trump's arrest is set to take place on Thursday.
"Having reviewed the evidence of possible corruption in the Fulton County District Attorney's office, specifically regarding the indictment of President Donald Trump and eighteen others, I believe it is time the General Assembly investigates this matter," Byrd wrote in a letter to her constituents. "Therefore, I write to inform you that I am signing to investigate possible malfeasance."
"As Senator Moore stated in his letter, we must investigate this matter further," she explained. "If wrongdoing is found, as a duly elected member of the Georgia House of Representatives I am prepared to begin the impeachment process."
"I encourage all my colleagues in both chambers to join me in signing Senator Moore's letter," the lawmaker said, concluding, "The people demand this matter be investigated fully. We must seek the truth by doing our constitutional duty of overseeing the judicial system, to ensure the oath of office enshrined in law, that every District Attorney must take before assuming office, is respected and adhered to."
As previously reported by the DC Enquirer, Sen. Moore sent a letter to Gov. Brian Kemp (R-GA) last week calling for a special session to consider impeachment of the Fulton County DA.
The move comes after Willis officially indicted President Trump and 18 other allies earlier this week for their actions following the 2020 presidential election. Trump specifically was hit with 13 charges including "Violation Of The Georgia Rico (Racketeer Influenced And Corrupt Organizations) Act," "Solicitation Of Violation Of Oath By Public Officer," "Conspiracy To Commit False Statements and Writings" and "Conspiracy To Commit Forgery in the First Degree," as well as a number of other charges.
“We must strip all funding and, if appropriate, impeach Fani Willis,” State Senator Moore said in a statement, as reported by Breitbart.
“As a Georgia State Senator, I am officially calling for an emergency session to review the actions of Fani Willis,” he explained. “America is under attack. I’m not going to sit back and watch as radical left prosecutors weaponize their elected offices to politically target their opponents.”
Moore's action is the first step in potentially launching an impeachment if an emergency session were to be called. Under Georgia law, Governor Kemp has the ability to unilaterally call a special session, or the state legislature, with 60 percent support, could also force an emergency session.
Moore has seemed to deploy the latter strategy in an effort to go around Gov. Kemp who has already vocalized his opposition against Trump's attempts to claim voter fraud took place in the state during the 2020 election. In addition, Kemp has refused to call a special session on the matter.
While it is unlikely that the Georgia state lawmakers will be able to force a special session via the 60 percent threshold given that Republicans control 57 percent of the lower chamber and 59 percent of the upper chamber, the move by Moore and Byrd is likely an attempt to force Gov. Kemp's hand. It is a step in the right direction and hopefully, more state lawmakers follow suit.
