Judge Thomas Kent Wetherell II, a judicial appointee of Donald J. Trump to the federal bench, reached a court decision that halted the Biden administration from releasing illegal aliens without setting court dates for these migrants to appear.
Under Biden's previous plan, in the event that the U.S. Customs and Border Protection service is unable to accommodate resources for the upcoming large wave of illegal immigration, they would release migrants from custody to parole, according to Just the News. Those under this parole release do not get an alien registration number nor receive a court date, according to Fox News. This process was previously allowed only for emergency humanitarian reasons. The judge's decision meant that the administration must wait at least two weeks before enacting this plan due to his restraining order.
Ashley Moodey (R-FL), the Sunshine State's Attorney General, challenged the Biden policy claiming to the judge that it would enact the same policy the judge rejected in March. That this decision comes amid the backdrop of the lifting of Title 42, a public health measure meant to fast-track the expulsion of illegal immigrants who come from a country known to host communicable diseases, is fortunate timing. Tens of thousands of migrants were already reported to already be arriving at the southern border and this ruling takes a tool out of Biden's toolbox that would have allowed more migrants to enter the country.
The crisis at the border, coupled with the administration's denialism, has further enraged those who want a secure border. Senator Ted Cruz (R-TX) at a press conference on the border voiced the frustration of many when he proclaimed that "In 2020, the last year in the Trump presidency, we had the lowest rate of illegal immigration in 45 years. You ask what I have done?!? I have championed the men and women of border patrol, I've championed securing the border, I've championed [the] Remain in Mexico [policy], and we turned this problem around and solved it. And we went from Joe Biden inheriting the lowest rate of illegal immigration in 45 years. And the first day in office, he made the political decisions to cause this problem!"
The Texan conservative called the crisis at the border during the same press conference "evil" and said that "the reason you don’t see any Democrats here is they can’t defend this.
