BREAKING: Georgia Judge Throws Out Some Charges In Fani Willis' Case Against Trump

On Thursday, Fulton County Judge Scott McAfee threw out two charges against 45th President Donald Trump in the election subversion case brought against him by Fulton County District Attorney Fani Willis. The ruling is the latest development in the Georgia case as Willis faces potential disqualification following Trump's appeal to the Georgia appeals court. Judge McAfee's decision to throw out some charges against Trump will not be officially applied until the Trump legal team's appeal is resolved.

Trump lawyer Steve Sadow explained that McAfee's ruling was a major victory for his client, stating in a statement that "President Trump and his legal team in Georgia have prevailed once again. The trial court has decided that counts 15 and 27 in the indictment must be quashed/dismissed." While Trump and several other co-defendents' cases are paused amid the appeal to determine if Willis should be disqualified from the case, two co-defendents, former Trump lawyer John Eastman and Georgia state Sen. Shawn Still, decided to opt out of the appeals process. 

According to CNN, Trump's dismissed charges include one count of filing false documents and one count of conspiring to file false documents.

As previously reported by the DC Enquirer, Judge McAfee's ruling came after he refused to disqualify Willis earlier this year but allowed the Trump team to appeal his decision. McAfee decided after a lengthy hearing that attempted to show that the Fulton County DA and special prosecutor Nathan Wade lied to the court over a relationship. McAfee explained in his ruling that no "disqualification of a constitutional officer [is] necessary when a less drastic and sufficiently remedial option is available." McAfee concluded that there was an "appearance of impropriety" due to Willis's relationship with Wade but that no "actual conflict" resulted from the affair. 

Willis charged President Trump and 18 other allies last year for their actions following the 2020 presidential election. Trump specifically was hit with 13 charges, including "Violation Of The Georgia Rico (Racketeer Influenced And Corrupt Organizations) Act," "Solicitation Of Violation Of Oath By Public Officer," "Conspiracy To Commit False Statements and Writings," and "Conspiracy To Commit Forgery in the First Degree," as well as a number of other charges.
