On Monday, a federal judge in the Del Rio district court handed down a massive victory for the state of Texas after Attorney General Ken Paxton (R-TX) and the Texas Public Policy Foundation (TPPF) filed a lawsuit against the Biden administration after members of the border patrol were actively cutting razor wire placed by the Texas National Guard to deter migrants.
TPPF Executive Director and General Counsel Robert Henneke explained that the ruling prevents the Department of Homeland Security and Customs and Border Patrol from "disassembling, degrading, tampering with" the state's concertina wire barriers.
Paxton and TPPF initially filed the lawsuit earlier this month after a video surfaced showing members of border patrol cutting razor wire to let migrants enter the Lone Star State. While the Texas National Guard, which is stationed at the border amid Operation Lone Star, replaced the concertina barriers, the Biden administration proceeded to use a forklift to dismantle the barriers.
"In response to our lawsuit, [Biden Administration] [DHS] has doubled down using a forklift tractor to dismantle the [Texas] razor wire barrier, allowing 310 people to enter illegally," Henneke wrote on Friday. "[AG Ken Paxton] & [TPPF] have filed an immediate TRO motion seeking emergency relief from the Court."
