On Friday, a district judge in Clark County, Nevada, dismissed the fake electors case brought against six Republicans who submitted an alternative slate of electors following the 2020 presidential election. The judge ruled that the case could not be brought in Democrat-leaning Clark County, given that the alleged crime took place in other parts of the state.
The judge's decision, as she put it, was a matter of jurisdiction. Clark County District Court Judge Mary Kay Holthus stated, "You have literally, in my opinion, a crime that has occurred in another jurisdiction. It's so appropriately up north and so appropriately not here." This ruling has significant legal implications, given that the prosecutors cannot bring the case in other jurisdictions due to a three-year statute of limitations, leading a lawyer for the defendants, Maggie McLetchie, to declare, "They're done."
The court's ruling is a welcome sign for the defendants, Nevada GOP Chairman Michael McDonald, Republican National Committeeman Jim DeGraffenreid, Clark County GOP Chairman Jesse Law, state party Vice Chair Jim Hindle, Shawn Meehan and Eileen Rice, but the legal fight isn't over. Nevada Attorney General Aaron Ford (D-NV) said that he would appeal the district court's decision and take the case up to the Nevada Supreme Court, according to the Nevada Independent.
The judge's decision is the first dismissal of a false elector case after cases were brought against Republicans in Michigan, Georgia, Arizona, and Wisconsin. "The sham case against Nevada's 6 alternate electors has been DISMISSED," TPUSA President Charlie Kirk wrote. "Congrats to the Nevada GOP and to all other electors throughout the country who have been targeted by weaponized, politicized AGs. Massive W for real justice."
