The Supreme Court struck down a federal ban on bump stocks on Friday in a significant victory for Second Amendment activists and a blow to the bureaucratic state that attempted to ban the attachments via procedural rules. The ATF rule, put into place by the Trump administration following the Las Vegas shooting at a concert that killed 58 people, was challenged by a Texas gun shop owner, Michael Cargill, who bought two bump stocks, gave them to the government in 2018, and then subsequently sued to get them back.
The court was divided along ideological lines, with the six conservative justices ruling the ban unlawful and the three liberal justices siding with the government. Justice Clarence Thomas wrote the majority opinion, and Justice Sonia Sotomayor authored the dissent.
“A bump stock does not convert a semiautomatic rifle into a machinegun any more than a shooter with a lightning-fast trigger finger does,” Justice Clarence Thomas wrote in his opinion. “Even with a bump stock, a semiautomatic rifle will fire only one shot for every ‘function of the trigger.’” Per CNN, the crux of the case, stemming from a 1930s law meant to combat gangsters using machine guns, revolved around the phrase "a single function of the trigger."
Justice Sotomayor, who took the additional step to read her opinion from the bench, argued that the majority's decision would lead to deadly consequences given that it “hamstrings the Government’s efforts to keep machineguns from gunmen like the Las Vegas shooter.”
“When I see a bird that walks like a duck, swims like a duck, and quacks like a duck, I call that bird a duck,” she wrote. “A bump-stock-equipped semiautomatic rifle fires ‘automatically more than one shot, without manual reloading, by a single function of the trigger.’ Because I, like Congress, call that a machinegun, I respectfully dissent.”
