When Joe Biden ran for the White House, he declared that “I have never spoken to my son about his overseas business dealings” and chalked this up to a smear campaign against him. The core of the allegations against Joe Biden and Hunter Biden was that the two were involved in a corrupt pay-for-play scandal where Hunter Biden would sell access to his father during his Vice Presidency. Fox News Digital recently reviewed emails and White House visitor logs and found that at least three of Hunter Biden’s business associates, one of whom was a foreign national, met then Vice President Joe Biden and his deputy chief of staff in 2011.
Fox News Digital noted that at the time of these meetings, Hunter was trying to negotiate deals with his business associates worth billions of dollars. Joseph Biden’s level of involvement in his son’s business dealings would contradict the notion that he had nothing to do with that. Fox News previously noted that when he was Vice President he met with “more than a dozen of Hunter’s business associates” as well as with top staffers at Hunter’s now-defunct company, Rosemont Seneca Partners, over 90 times.
Paul Kamenar, a counsel to the National Legal and Policy Center, informed Fox News Digital that the new 2011 emails and records could translate into additional alleged Foreign Agents Registration Act (FARA) violations for Hunter Biden. Kamenar noted that “If this person or persons met with Biden at the behest of his son, Hunter, and Hunter somehow was being paid directly or indirectly to arrange that meeting, then we would argue that, yes, he would have to register as a foreign agent of that foreign entity.”
Kamenar added that “It strains credulity to think that his dad is totally clueless of what his son’s up to.”
Mr. Kamenar is not the only legal authority who noticed the serious risk of such activities violating FARA. Law Professor Jonathan Turley wrote on Twitter that “The new collection of emails show Hunter's involvement in planning meetings with his Dad, including foreign clients… Once again, it is striking that leaks from the Justice Department do not include potential charges under FARA as an unregistered foreign agent.”
Professor Turley wrote back in April 2022 that already there was enough evidence to charge Hunter Biden with FARA violations since Hunter had not registered as a lobbyist for a foreign actor. He noted one particular email where Hunter acknowledged he and his uncle were in danger of triggering FARA.
Turley wrote that “The e-mail is a prosecutor’s dream. FARA violations, like tax violations, can be viewed as cut-and-dried charges for jurors. In this case, the potential defendant not only incriminated himself under the law, but his associates and family, as well.”
Many commentators have noted that the justice system does not seem slow to use FARA charges against Trump allies yet they are slow to use the same tool against Biden. Worse still there are serious allegations that the FBI and DOJ are covering up for the president.
