Facing the Consequences: Federal Judges Will Not Hire Stanford Students After Free Speech Silencing

On Saturday, Fifth Circuit Judge James Ho and Judge Elizabeth Branch announced that they will no longer be hiring law students as clerks from Stanford University after students there shut down an event with Judge Kyle Duncan earlier this month.

The two federal judges, who preside over Texas, Louisiana, and Mississippi, made the announcement after Duncan was unable to speak at an event hosted by the local chapter of the Federalist Society because students shouted him down, as reported by Breitbart.

When the Associate Dean for Diversity, Equity, and Inclusion Tirien Steinbach stepped in, she sided with the protesters rather than the judge leading to condemnation following clips of the incident going viral.

Following the incident, Stanford Law School Dean Jenny Martinez attempted to do damage control to save the law school’s reputation via a ten-page letter in which he apologized to Duncan and mandated a half-day session for all law students on the importance of freedom of speech.

These measures, however, did not satisfy Judge Ho, as evidenced by a speech he delivered to the Texas Review of Law & Politics, as reported by the Washington Free Beacon.

“These three elements are plainly missing at Stanford Law School,” Ho began. “Just look at the ten-page letter that was recently issued by the Dean. I know that letter has been praised by some people for standing up for free speech. I don’t share that view.”

“Well, here’s the problem: The words in that letter are not accompanied by concrete actions,” he explained. “Because it imposes zero consequences on anyone. It doesn’t even say whether there will be consequences if there’s a disruption in the future.”

“These problems aren’t unique to one or two schools. But I think it’s obvious why so much attention has focused on one or two schools. It’s because they present themselves as the nation’s best institutions of legal education,” he stated. “Yet they’re the worst when it comes to legal cancellation. Moreover, what happens at these elite schools impacts the profession and the country.”

With students at Stanford setting a terrible example for the future of the profession, it is apparent that dire consequences, such as withholding clerkships, are in order. Only then will these universities change their ways when reality actually hits the students who would rather shout down speakers than secure a job.
