'Not Going To Tolerate Jack Smith's Bullsh*t': Judge Cannon Strikes A MASSIVE Blow In Jack Smith's Case Against Trump

U.S. District Court Judge Aileen Cannon dealt a severe blow to the Biden Department of Justice's prosecution of 45th President Donald J. Trump early Monday morning when she struck down two sealed filings from prosecutors and demanded the government explain its use of an ongoing grand jury investigation outside her district.

In the order issued, Cannon ordered prosecutors to "address the legal propriety of using an out-of-district grand jury proceeding to continue to investigate and/or to seek post-indictment hearings on matters pertinent to the instant indicted matter in this district."

Senior legal affairs reporter for Politico, Kyle Cheney observed, "Judge CANNON comes out swinging at special counsel this morning, striking two of prosecutors' sealed filings and demanding an explanation of 'the legal propriety of using an out-of-district grand jury proceeding to continue to investigate' the docs case."

Author, political commentator, and Senior Contributor to American Greatness Julie Kelly offered her assessment in an X App thread, writing, "I told you Judge Cannon is legit. She is not going to tolerate Jack Smith's bullsh*t. This is gold--she asks defense to raise possible grand jury abuse by DOJ for conducting nearly all of the investigation in DC then switching to FLA at last minute for indictment."

She added, "Cannon also won't tolerate DOJs nonstop requests for secrecy. She already denied a govt motion asking to keep names of 80+ witnesses under seal."

Kelly explained that the denial related to a DOJ attempt to remove attorney Stanley Woodward, representing co-defendant and Trump advisor Waltine Nauta. A cloud of controversy hangs over the motion regarding Woodward as Kelly noted, "Recall Smith's lawyer Jay Bratt is accused of threatening Woodward over judgeship application if he didn't get Nauta to cooperate."

According to Axios, prosecutors wrote in the court filing regarding Woodward, "A potential conflict exists because Mr. Woodward previously represented one witness and currently represents two other witnesses who the Government may call to testify at the trial of his client Nauta." 

Prosecutors claimed that Woodward representing Nauta could leave him "in the position of cross-examining past or current clients."

The Hill reported that Special Counsel Jack Smith requested a conference with Nauta, warning that Woodward, "may not be able to provide sufficient representation." The DOJ wrote that the hearing, known as a 'Garcia hearing' was requested with Woodward's clients, both Nauta and potential witnesses he represents “to inform them of potential risks and inquire into possible waivers,” and adding that the court could provide additional independent counsel to Nauta.
