Minnesota Gov. Signs Chilling New Law – Courts Now Overrule Parents On ‘Gender-Affirming Health Care’ For Children

Governor Tim Walz (D-MN) has signed a bill into law authored by transgender Democrat state representative Leigh Finke that allows state courts to, among other things, take “temporary emergency jurisdiction” if “the child has been unable to obtain gender-affirming health care.”

The law, referred to by Democrat Lt. Governor Peggy Flanagan as the “Trans Refuge Bill,” (HF 146) requires that Minnesota not enforce or apply “A law of another state that authorizes a state agency to remove a child from the child’s parent or guardian because the parent or guardian allowed the child to receive gender-affirming health care.”


The new law also blocks all subpoenas in criminal or civil courts “when the other state’s laws are designed to interfere with an individual’s right to receive gender-affirming health care,” essentially establishing Minnesota as a ‘sanctuary state’ for parents and children seeking out “gender-affirming health care” in defiance of other states’ court orders, parental intervention or state laws.

Further, the bill codifies “Gender-affirming health care” as,

“medically necessary health care or mental health care that respects the gender identity of the patient, as experienced and defined by the patient, and that may include but is not limited to:
(1) interventions to suppress the development of endogenous secondary sex characteristics;
(2) interventions to align the patient’s appearance or physical body with the patient’s gender identity;
(3) interventions to alleviate the patient’s symptoms of clinically significant distress resulting from gender dysphoria as defined in the current version of the Diagnostic and Statistical Manual of Mental Disorders; and
(4) developmentally appropriate exploration and integration of the patient’s gender identity, reduction of the patient’s distress, adaptive coping, and strategies to increase family acceptance of the patient’s gender identity.”

Finke claimed in March, “In the staggering rise of anti-transgender and anti-LGBTQIA2S+ legislation by extremist Republicans, Minnesota is a beacon of hope for trans and gender-expansive children and their families. The passing of the Trans Refuge bill will send a strong message to the trans community that they are loved, supported, and protected here in our state,” according to Rebel News.

The outlet also reported that Republican State Representative Peggy Scott warned the new law undermines parental rights and doesn’t safeguard children. She explained, “House File 146 allows children, regardless of age, to receive radical medical treatments.”


The same month, Lt. Gov. Flanagan urged parents not to attempt to dissuade their children from seeking so-called “gender-affirming care.” She wore a shirt that read “Protect Trans Kids” and depicted a dagger. She told the gathered activists, “Let’s be clear: this is life-affirming and life-saving health care. When our children tell us who they are, it is our job as grown-ups to listen and to believe them. That’s what it means to be a good parent.”

Now, with the force of law behind it, Flanagan’s rhetorical dagger on her shirt won’t be necessary. Minnesota courts will enforce the transgender agenda – just as all authoritarian regimes do – at the barrel of a gun.

It appears that a state of ‘Civil Lawfare’ is escalating in the United States, with individual states enacting laws directly in contradiction to each other.
