'Should Be Dropped Immediately': Team Trump Moves To Dismiss Classified Documents Case Over Alleged Evidence Tampering

On Tuesday, presumptive GOP nominee Donald Trump's legal team moved to dismiss the classified documents case brought against him by special counsel Jack Smith in Florida. Trump's attorneys argued to Judge Aileen Cannon that the Department of Justice had tampered with evidence during their raid of Mar-a-Lago in 2022. 

The attorneys argue that the FBI agents involved with the operation disregarded instructions from the bureau to document the exact location of where the classified documents were found and instead focused on preparing a photo shoot that would then be leaked to the national press. The attorney's motion, filed in the US District Court of West Palm Beach, argued that these actions resulted in a "spoilation of evidence in violation of due process."

"The prosecution team destroyed exculpatory evidence supporting one of the most basic defenses available to President Trump in response to the politically motivated charges in this case," the legal team explained. "The government was more interested in staging—and leaking—manipulated photographs to the press than preserving key exculpatory evidence that has now been lost forever."

"President Trump's attorneys have filed a powerful motion asking Judge Cannon to fully and completely dismiss the 'boxes' Hoax due to the illegal actions by Crooked Joe Biden's Department of Injustice in its shocking failure to preserve the boxes taken from President Trump's home in the unconstitutional and unAmerican raid on Mar-a-Lago," Trump campaign spokesman Steven Cheung said in a press release. "Deranged Jack Smith was forced to admit in a public filing that he and his Thugs committed blatant Evidence Tampering by mishandling the very documents they used as pretext to bring this Fake Case. This scam, and all other Crooked Joe - directed Witch Hunts against President Trump, should be DROPPED IMMEDIATELY."

While Judge Cannon denied previous attempts by Team Trump to dismiss the case, she postponed the trial indefinitely to account for various pre-trial issues. As previously reported by the DC Enquirer, Judge Cannon postponed the May 20 trial date to ensure that the defendant got due process and the public received a fair and efficient administration of justice.

"The Court...determines that finalization of a trial date at this juncture—before resolution of the myriad and interconnected pre-trial and CIPA issues remaining and forthcoming—would be imprudent and inconsistent with the Court's duty to fully and fairly consider the various pending pre-trial motions before the Court, critical CIPA issues, and additional pre-trial and trial preparations necessary to present this case to a jury," the judge ruled. "The Court, therefore, vacates the current May 20, 2024, trial date (and associated calendar call), to be reset by separate order following resolution of the matters before the Court, consistent with Defendants' right to due process and the public's interest in the fair and efficient administration of justice."
