On Wednesday, Gov. Greg Abbott (R-TX) sent a letter to all public colleges and universities in the Lone Star State instructing them not to comply with President Joe Biden's radical rewrite of Title IX that violates the "integrity of women's sports."
As previously reported by the DC Enquirer, the Biden administration updated Title IX last month by including sexual orientation and gender identity as protected classes. The change could open up colleges and universities that receive federal funding to lawsuits if they refuse to allow male students who identify as females to access women's locker rooms. The new rules also could put female athletes' scholarships at risk, and it also reverses the hard-fought due process protections for those accused of sexual harassment.
The Biden administration initially attempted to propose a rule that would have forced federally funded institutions to allow men who identify as female to compete in women's sports, but they reversed course after considerable backlash and the upcoming 2024 election. The Title IX changes were made amid considerable scrutiny, with hundreds of thousands of comments from the public being considered.
In response to the decision, Gov. Abbott directed public universities to refrain from making any new policy-related changes to Title IX policy, writing, "As I have already made clear, Texas will not comply with President Joe Biden's rewrite of Title IX that contradicts the original purpose and spirit of the law to support the advancement of women."
"Last week, I instructed the Texas Education Agency to ignore President Biden's illegal dictate of Title IX. Today, I am instructing every public college and university in the State of Texas to do the same," Abbott's letter reads. "I signed laws to ensure the safety of our students on campus and provide a process for adjudicating reports of sexual harassment and sexual assault with adequate due process for all parties involved, as well as laws to protect the integrity of women's sports by prohibiting men from competing against female athletes-and I will not let President Biden erase the advancements Texas has made."
In addition to ignoring the Biden administration's rewrite at the state level, Texas Attorney General Ken Paxton (R-TX) also sued the federal government for the blatantly "illegal" rewrite. "Texas will not allow Joe Biden to rewrite Title IX at whim, destroying legal protections for women in furtherance of his radical obsession with gender ideology," Attorney General Paxton said. "This attempt to subvert federal law is plainly illegal, undemocratic, and divorced from reality. Texas will always take the lead to oppose Biden's extremist, destructive policies that put women at risk."
