A new poll out from The Daily Mail/TIPP showed that more than half of Americans, including a majority of Democrats, believe that the gag order pushed on leading Republican presidential candidate and 45th President Donald Trump by New York Judge Arthur Engoron and Washington, D.C. Judge Tanya Chutkan, violates Trump's First Amendment rights.
The poll, which was from November 1st to November 3rd and included 1,000 Americans, found that 56 percent of those polled believe that the gag order violates Trump's freedom of speech. Nearly a third of respondents, 32 percent, said that the orders did not infringe on Trump's First Amendment rights, and 12 percent said they did not know. A more thorough breakdown showed that 70 percent of Republicans, 57 percent of Democrats, and 41 percent of independents agreed that the orders went against the 45th president's constitutional rights. Meanwhile, only 20 percent of GOPers, 36 percent of Democrats, and 40 percent of independents disagreed with that assessment and sided with the judges.
The orders were handed down last month and have faced significant criticism from lawmakers across the country, including Rep. Elise Stefanik (R-NY), who deemed the legal order to be "unconstitutional and illegal." This fact, along with the various ethical issues present in Engoron's handling of the case against Trump, prompted the New York Republican to issue an ethics complaint on Friday. "I just filed an official judicial complaint against Judge Arthur Engoron for his inappropriate bias and judicial intemperance in New York's disgraceful lawsuit against President Donald J. Trump and the Trump Organization," Stefanik wrote on Twitter. "Americans are sick and tired of the blatant corruption by radical Leftist judges in NY. All New Yorkers must speak out against the dangerous weaponized lawfare against President Trump."
"I write today to express my serious concerns about the inappropriate bias and judicial intemperance shown by Judge Arthur F. Engoron in New York's lawsuit against President Donald J. Trump and the Trump Organization," the complaint reads. "This judge's bizarre behavior has no place in our judicial system, where Judge Engoron is not honoring the defendant's rights to due process and a fair trial."
On October 3rd, Judge Arthur Engoron issued a gag order on the former president to prevent him from criticizing the court's staff. This came after President Trump posted an image of a court clerk alongside Sen. Chuck Schumer (D-NY) to his personal Truth Social page, as reported by Newsmax. "Personal attacks on members of my court staff are unacceptable, inappropriate, and I won't tolerate it," Engoron said at the time. "Consider this a gag order on all parties with respect to posting or publicly speaking about any member of my staff." Trump was eventually issued a $10,000 fine by Engoron for violating the order, and he also expanded the gag order to include Trump's attorneys.
In addition to Engoron's order, Judge Tanya Chutkan also issued a gag order on President Trump to prevent him from criticizing those going after him in the 2020 election case. More specifically, the order restricts him from commenting on the prosecutors, court staff, and potential witnesses in the case brought by Special Counsel Jack Smith. The order was eventually lifted by the Court of Appeals for the D.C. Circuit last week, with oral arguments set for November 20th.
As more and more Americans begin to see the blatant malfeasance underway in these various trials against Trump, even the most partisan of people can realize the unconstitutional nature of the prosecution against Trump. The former president should not be silenced, and these gag orders should be rescinded.
