Biden Takes Unilateral Action Against Second Amendment With New Executive Order

On Tuesday, President Joe Biden signed into effect an Executive Order expanding the requirement for background checks, usurping Congressional authority by altering the definition of who “is ‘engaged in the business’, from someone with the “principal objective of livelihood and profit,” to someone who would “predominately earn a profit.”

The move as explained in the White House’s fact sheet would expand the background check requirement to encompass private sales between individual gun owners, something that Congress never intended with the stated goal of getting “as close to universal background checks as possible without additional legislation.”

The order also instructs federal officials to actively promote “Red Flag Laws,” that allow for the proactive extrajudicial seizure of legally owned firearms from citizens who have not committed any crimes. Biden and other Second Amendment opponents suggest that these laws could prevent mass shootings.

According to The Epoch Times, the order also requires:

  • “the Federal Trade Commission to issue a report on how gun manufacturers market to children,
  • requires federal officials to report on gun dealers who break the law,
  • requires stricter reporting of firearms that are lost or stolen in shipping,
  • and for the federal government to provide assistance after a shooting similar to the aid made available after a natural disaster.”

Biden reportedly announced the order from Monterey Park, California using the community impacted by the mass shooting that claimed 11 lives and injured nine others in January as a backdrop for this latest assault on the Second Amendment rights of the American people.


The Gun Owners of America shared a video of his announcement Tuesday with the caption, “President Biden (@POTUS) announced an executive order to implement backdoor universal background registration checks (UBCs) WITHOUT CONGRESS OR A NEW LAW.  This is a direct violation of the Constitution & will do NOTHING to keep firearms out of the hands of criminals.”

Biden told the American people, “My executive order directs my Attorney General to take every lawful action possible to move us…to universal background checks without legislation.”

The National Rifle Association offered a statement to Twitter in response, “Crimes are committed by criminals. Until President Biden and his allies decide to go after violent criminals, violence will continue to spiral out of control as it has. The focus of our laws and efforts should be on the criminal…”
