On Monday, House Republicans of the House Judiciary Committee filed a lawsuit against Attorney General Merrick Garland for the audio recording of President Joe Biden's infamous interview with special counsel Robert Hur that described Biden as a "well-meaning, elderly man with a poor memory." This comes weeks after the Biden White House used executive privilege to block Garland from releasing the audio to Congress. House Republicans chose to respond by voting to make Garland the third attorney general in U.S. history to be held in contempt of Congress. The Justice Department failed to take up the contempt referral due to Biden's executive privilege.
Hur's 345-page report declined to bring charges against Biden over his illegal handling of classified documents when he was a senator and vice president, describing him as an "elderly man" with "poor memory." Biden famously claimed that special counsel Robert Hur asked him when his late son, Beau Biden, died, but that turned out to be a lie. Biden told reporters in a surprise White House press conference after Hur's 345-page report was published, "How in the hell dare he raise that? Frankly, when I was asked the question, I thought to myself, it wasn't any of their damn business." According to a report, Hur never asked Biden that question. In reality, Biden voluntarily brought up his son's death after being asked about his Virginia rental home workflow from 2016 to 2018. Biden failed to answer the question and instead answered the incorrect year of when his son died.
This comes after Biden's first presidential debate with 45th President Donald Trump. A flash CNN poll following the historic debate showed President Trump crushing Biden with a massive landslide of 67 percent and a minor 33 percent for Biden. During a campaign rally in Chesapeake, Virginia, of over 25,000 people, Trump said he "had a big victory against a man looking to destroy our country." Trump said that Biden's "problem is not his age" but his lack of "competence" since Trump knows people older than Biden who "are doing wonderful things." "You know, there's great wisdom if you're not in a position like him. But if you go back 25 years, he wasn't the sharpest tack either," Trump said.
Retired neurosurgeon and former head of Housing and Urban Development under the Trump administration, Dr. Ben Carson, told Newsmax back in April, "Some people are saying, at his age, I know a lot of people who are older than him who are mentally quite agile. There's something more wrong. And this is a problem that could be easily resolved by him doing a mental status test. Why are they afraid to do a mental status test? If they are so certain that he is sharp as a tack, that would not be an issue at all, so obviously, something is being hidden there. You don't have to be a doctor to see that he has declined."
