'Hiding The Ball': Leading Attorney Exposes The Corrupt Hunter Biden Plea Deal, Lays Out The Real Reason Why It Broke Down

On Wednesday, conservative activist, prosecutor, and Missouri Attorney General candidate Will Scharf laid out a compelling case for why Hunter Biden's plea agreement broke down.

"Based on conversations with people who were in the courtroom today, and my experience as a former federal prosecutor, I think I know the full story of what happened with the Hunter Biden plea agreement blow-up this morning," Scharf began.

As the DC Enquirer previously reported, "President Biden's son, Hunter Biden, appeared before a federal judge in Delaware to enter a guilty plea after the Biden Department of Justice provided him with a sweetheart deal for tax crimes and a firearm charge last month. The deal, however, has collapsed, according to CNN... Hunter attempted to plead guilty to two misdemeanors and a felony for the illegal possession of a firearm. This deal, which would have given no jail time to the president's son, has fallen apart given investigations are ongoing. He will, however, still be pleading guilty to the misdemeanor charges for tax evasion."

With this in mind, Scharf laid out the legal reasoning for what transpired on Wednesday, saying, "Typically, if the Government is offering to a defendant that it will either drop charges or decline to bring new charges in return for the defendant's guilty plea, the plea is structured under Federal Rule of Criminal Procedure 11(c)(1)(A). An agreement not to prosecute Hunter for FARA violations or other crimes in return for his pleading guilty to the tax misdemeanors, for example, would usually be a (c)(1)(A) plea. This is open, transparent, subject to judicial approval, etc."

For contest, as the DC Enquirer previously reported, "the Foreign Agents Registration Act or FARA applies to 'any person who acts as an agent, representative, employee, or servant, or any person who acts in any other capacity at the order, request, or under the direction or control, of a foreign principal or of a person any of whose activities are directly or indirectly supervised, directed, controlled, financed, or subsidized in whole or in major part by a foreign principal.'" Indeed, as a result of potential FARA violations, America First Legal was suing the Justice Department over what they perceived as clear injustice.

"In Hunter's case, according to what folks in the courtroom have told me, Hunter's plea was structured under Federal Rule of Criminal Procedure 11(c)(1)(B), which is usually just a plea in return for a joint sentencing recommendation only, and contained no information on its face about other potential charges, and contained no clear agreement by DOJ to forego prosecution of other charges," Scharf added. "Instead, DOJ and Hunter's lawyers effectively hid that part of the agreement in what was publicly described as a pretrial diversion agreement relating to a § 922(g)(3) gun charge against Hunter for being a drug user in possession of a firearm."

Scharf then added that the plea deal was a net positive for Hunter and would effectively give him some immunity from future scrutiny. This did not sit right with presiding Judge Maryellen Noreika, who Scharff said, "understood that the lawyers were trying to paint her into a corner and hide the ball. Instead, she backed DOJ and Hunter's lawyers into a corner by pulling all the details out into the open and then indicating that she wasn't going to approve a deal as broad as what she had discovered."

In conclusion, Scharf said that the final agreement between Noreika and Hunter Biden's lawyers would be much narrower. He was doubtful if the foreign agent charges would be included in the final deal -- which would open Hunter Biden up to future investigations if need be. If true, this would be a major loss for the Biden Crime Family in their quest to avoid the consequences of their misdeeds.
