On Tuesday. New Mexico Attorney General Raul Torres (D-NM) announced that he would not defend Governor Lujan Grisham's (D-NM) anti-second amendment emergency order -- the Public Health Emergency Order Imposing Temporary Firearm Restrictions, Drug Monitoring, and Other Public Safety Measures.
"I am writing to inform u that my office will not defend your administration in the above-referenced cases challenging the Public Health Emergency Order Imposing Temporary Firearm Restrictions, Drug Monitoring and Other Public Safety Measures (the Emergency Order) issued by the Secretary of Health on September 8, 2023,” Torres said in a letter.
As the DC Enquirer previously reported, "On Friday, Governor Michelle Lujan Grisham (D-NM) issued an emergency order suspending the constitutional right to carry firearms in public throughout Albuquerque and surrounding counties for at least 30 days following an uptick in gun violence." She also claimed that no rights were absolute, so the Second Amendment is no exception.
These remarks were patently absurd, and just about everyone could see through them. Indeed, radical liberal anti-gun activist David Hogg called out the New Mexico governor, saying, "I support gun safety but there is no such thing as a state public health emergency exception to the U.S. Constitution."
Torres continued, saying, "Though I recognize my statutory obligation as New Mexico’s chief legal officer to defend state officials when they are sued in their official capacity, my duty to uphold and defend the constitutional rights of every citizen takes precedence. Simply put, I do not believe that the Emergency Order will have any meaningful impact on public safety but, more importantly, I do not believe it passes constitutional muster."
Torres is not the first public official to part ways with the governor on enforcing the order. Earlier this week, top sheriffs expressed their disdain towards the order. As the DC Enquirer previously reported, "Albuquerque Police Chief Harold Medina already told officers not to focus on the new ban, writing in a message Friday night, 'The governor made it clear that state law enforcement, and not APD, will be responsible for enforcement of civil violations of the order. Our officers at APD will continue to focus on the enforcement of criminal laws and arresting the criminals who are driving violent crime in the city,' per Santa Fe New Mexican."
Attorney General Torres then expressed his sympathy with the governor's concerns about gun violence. Nonetheless, he argued the governor needed to take a more 'thoughtful' approach to the issue of gun ownership in America.
"I encourage you to engage in a more thoughtful and deliberative process with members of the New Mexico Legislature rather than taking unilateral action that infringes on the constitutional rights of law-abiding citizens while having little if any discernible impact on the underlying dynamics driving gun violence in our community," Torres remarked.
