Second Amendment Victory: Nebraska Becomes 27th State With NRA-Backed Constitutional Carry

With the stroke of Republican Governor Jim Pillen’s pen, Nebraska will become the 27th state of the United States of America to legalize permitless concealed-carry of firearms or ‘constitutional carry’, as defined by the NRA. A true majority of states now allow for the legal exercise of their citizen’s Second Amendment rights without a state permit.

On Wednesday, according to Fox News, the Nebraska GOP overcame 14 hours of Democrat filibustering and three rounds of debate to pass Legislative Bill 77 the “Constitutional Carry” bill by a margin of 33-14.


Reportedly the new law doesn’t override federal background check requirements or restrictions on purchasers with a criminal history or mental health issues but, “allows eligible people to carry guns hidden in their clothing or vehicle without having to pay for a government permit or take a gun safety course, which is currently required.” The law requires gun owners to be 21 years of age or older to concealed carry without a permit.


The new law, however, does supersede stricter measures previously in place in Omaha and Lincoln, the state’s largest and most left-leaning cities which vehemently opposed the bill.

According to KLKN-TV, an activist in the balcony during the vote yelled “shame” at the state senators after they passed the new law.


Republican state Sen. Tom Brewer, the bill’s sponsor has pushed for it since 2017 and voiced his frustration at the six years of opposition he faced to enshrine Nebraskan’s constitutional rights. As an Army combat veteran, himself wounded several times by Taliban gunfire in Afghanistan, Brewer stressed the regulation of firearms “is not an easy thing,” according to Fox.

“If you’re on the receiving end of a bullet, … you understand how that can change and impact lives,” he said.

He told KLKN, “What we do in this body sometimes is trying to follow through with the will of the people and give them the rights that they have in the Constitution.”

Brewer added, “And sometimes we go out of the way and twist those rights and keep people from having them, and I think (the concealed carry permit) is a case of that.”

Gov. Pillen told reporters that he will sign the bill into law and it will reportedly take effect 90 days later.
